近日纳溪区人民法院审结了一起因离婚引出的财物损害赔偿纠纷,判决由被告张强赔偿原告李梅保险窗、铝合金窗、门损失费、鉴定费共计9088元,被告王波承担连带责任。由被告王波恢复电、天然气、有线电视户头,限于判决生效后10日内恢复。如王波未按时自行恢复,由王波承担恢复产生的费用。
 
Recently, the People's Court of Naxi District concluded a dispute over compensation for property damage caused by divorce. Zhang Qiang, the defendant, awarded compensation to the plaintiff for Li Mei's insurance window, aluminium alloy window, door loss fee and appraisal fee totalling 9088 yuan. Wang Bo, the defendant, was jointly and severally liable. Wang Bo, the defendant, shall resume his electricity, natural gas and cable accounts within 10 days after the judgment takes effect. If Wang Bo fails to recover on time, Wang Bo will bear the cost of recovery.
 
妇女权益律师:原告李梅与被告王波原系夫妻关系,被告张强系王波的姐夫。李梅与王波于2005年3月25日经纳溪区人民法院调解离婚,并于当日签领离婚调解书,双方协议:位于纳溪区安富先紫路1幢4—1号砖混结构住房(面积99.58平方米)一套归李梅所有,其他财产归王波所有。约定交房时间为2005年4月2日。王波后注销了该住房内的电视收视、天然气、用电户头。张强在王波交房期间,雇请人员将该住房的保险窗、铝合金窗、门全部取走。经泸州市纳溪区价格认证中心对原告受损物品进行估价,鉴定价格为人民币8730元。

法院认为:房屋内的水、电、气、有线电视等无形物质是附属于房屋才具有实用价值,且将水、电、气、有线电视户头与房屋分属二人所有,则房屋所有人不能正常生活居住,显然不符合客观事实,且在离婚时,民事调解书已确定了争议的住房属李梅所有,该房屋的所有人系李梅,在没有特别约定情况下,电、气、有线电视户头也应属李梅所有。被告张强事后采取了损坏房屋现有设施的行为,已侵害了原告的合法权益,被告王波属房屋的实际管理人员,应保持房屋原状交给原告,故对张强的毁损行为应承担连带责任。因此法院作出了前述判决。(文中人物均系化名)
